Embezzling public funds in Minnesota

In a previous post, the federal penalties for embezzlement were covered. However, in Minneapolis, and other cities across the state, embezzlement is also punishable under Minnesota law. When individuals are accused of embezzling funds, the consequences may extend far beyond imprisonment and financial penalties. For example, people may never find an employer willing to hire them in their line of work due to their criminal record.

According to the Office of the Revisor of Statutes, those who embezzle public funds in Minnesota can face prison time and stiff fines. People accused of this offense may face a maximum fine of $20,000 in addition to a 10 year prison sentence if the public funds they embezzled exceeded $2,500. Furthermore, those accused of embezzling under $2,500 in funds may face a $10,000 fine and five years behind bars.

The Revisor of Statutes also points out that public employees are required to report the embezzlement of public funds right away. For example, if a teacher, firefighter or law enforcement official finds out that public funds have been misused, they are supposed to provide information related to unlawful embezzlement to authorities and the state auditor immediately. Those reporting embezzlement are supposed to provide the state auditor with a written account outlining what supposedly took place.

Unfortunately, some people are falsely accused of embezzlement and these allegations can destroy their life. Even after they have served their time and paid the fines, their reputation could have permanent damage that prevents them from landing another job. As a result, it is crucial for people in this position to carefully assess their options.
