What to expect from a criminal defense attorney

Being arrested and charged with a crime can be scary, and the accused will likely be worried about how a conviction will impact his or her future. Having a good defense attorney on one’s side throughout all stages of the process can help protect the rights and liberties of the accused and ensure an outcome that is in his or her best interests. Although each case is different, a criminal defense attorney will follow certain protocols and guidelines when crafting an effective defense strategy.

In order to begin crafting a defense against criminal charges, a defense attorney needs to understand all aspects of the case, including the exact charges against the client, what events led up to the arrest, how the arrest transpired, and what evidence the prosecution has against the accused. In most instances, the accused’s story of what happened and the prosecution’s version of what happened will likely be very different. However, the accused will need to be very open and honest about his or her version of the events so that the defense lawyer can craft a story that is based in fact but geared toward the goal of protecting the accused while disproving the prosecution’s version. Even if the accused confessed to a crime or is otherwise obviously guilty of the charges, a well-crafted defense story can lead to a plea deal or a reduction in charges.

Additionally, a defense attorney will scrutinize the evidence the prosecution has against the accused as well as critically analyze the processes and circumstances surrounding the arrest. Did law enforcement infringe upon the accused’s rights during any searches or seizures? Was the accused unduly targeted during an investigation? Was the accused read his or her rights when arrested and were the proper processes followed during the arrest, the booking and any interrogations? The defense attorney will ask these questions and more to determine whether law enforcement violated the constitutional rights of the accused in any way.

No matter what criminal charges a person faces, that individual is entitled to a defense against those charges. Having an experienced criminal defense attorney on one’s side can make all the difference when it comes to how the case will play out in court. To protect one’s rights and liberties in the face of criminal charges, one should enlist the help of an attorney as soon as possible after an arrest.
